GOOD INFRASTRUCTURE. CLEAR EXPECTATIONS.
Terms of service.
Your ideas deserve room to grow. Here are the ground rules for building with Node110.
1. About these terms
These terms govern your use of the Node110 website, accounts, workspaces, and any hosting or related services we agree to provide. “Node110,” “we,” and “us” refer to the provider of those services; “you” means the person or organization using them.
By creating an account or using our services, you agree to these terms. You must be legally able to enter into this agreement. If you act for an organization, you confirm that you have authority to bind it. If you do not agree, do not create an account or use the services.
A separately agreed written service order or enterprise agreement takes precedence over these terms where they conflict. Nothing here limits rights or protections that applicable law does not allow us to exclude.
2. What the service includes
Available features, resource limits, and support depend on your agreed plan or service order. Descriptions of possible features are not a promise that every feature is available for every account.
Saved project and Google Cloud configurations are drafts, not live deployments. Saving a configuration does not provision infrastructure, deploy an application, or establish an uptime commitment. Any live hosting or infrastructure provisioning must be separately enabled and authorized.
We may maintain, improve, or change the service. We will give reasonable notice of material reductions to an active paid service where practicable, except when urgent security, legal, or operational circumstances require immediate action.
3. Accounts and security
Provide accurate account details, keep your email address current, and complete email verification. You are responsible for safeguarding your credentials, access tokens, application secrets, and the activity you authorize through your account.
Use individual logins rather than sharing passwords. Tell us promptly through our contact page if you suspect unauthorized access. Do not send passwords, private keys, or payment details in a support message.
4. Team access and permissions
Invite only people you trust. Team permissions determine which projects a member can view and manage and whether they can create projects. Members with all-project access and creation permission can also manage the connected GitHub account and team, but cannot remove the workspace owner.
You are responsible for the permissions you grant and for reviewing and removing access when it is no longer needed. Removing a member does not undo changes they have already made or revoke information they previously accessed. Membership does not transfer ownership of your code or the workspace.
5. Acceptable use
You must use Node110 lawfully and respect the rights and security of others. You must not:
- Host or distribute unlawful content, malware, phishing pages, stolen credentials, or material that infringes intellectual property or privacy rights.
- Send spam, commit fraud, facilitate abuse, or use the service to threaten or exploit others.
- Attempt unauthorized access, scan or attack systems without permission, bypass security controls, or interfere with other customers.
- Evade resource limits, billing, account restrictions, or suspension by creating additional accounts or misrepresenting usage.
- Run cryptocurrency mining or other unusually resource-intensive workloads without our prior written agreement.
- Use the service for safety-critical systems where failure could cause death, personal injury, or severe environmental damage without a separate written agreement.
We may investigate suspected abuse and restrict activity that threatens the service or others. Report abuse through our contact page.
6. Your content and intellectual property
You retain ownership of your code, content, and application data. You grant us only the rights needed to store, process, transmit, and, where enabled, host that material to provide and secure the service and fulfill your instructions.
You are responsible for having the necessary rights, licenses, and permissions for your content and workloads. You are also responsible for the applications you operate, including their updates, end-user terms, and legal compliance.
Node110 and its licensors retain ownership of the platform, branding, and other materials we provide. These terms do not grant ownership of that material or permission to misuse our name or marks.
7. Third-party connections
Connections such as GitHub and any authorized cloud services are also subject to the relevant provider’s terms, availability, and charges. You must have authority to connect each account and repository and should review the access permissions before authorizing them.
We do not control third-party services and cannot guarantee their continued availability or compatibility. Disconnecting a provider from Node110 does not necessarily cancel resources, subscriptions, or authorizations held directly with that provider.
8. Plans, usage, and payment
The platform subscription and infrastructure usage are separate unless your service order expressly says otherwise. Project allowances do not include unlimited compute, storage, databases, or network usage. Review the pricing page and your service order before purchasing or authorizing resources.
The monthly platform fee is collected through Stripe at signup and renews monthly. Actual attributed service usage, including the agreed management markup, is added in arrears to the next monthly invoice. Late provider reports or corrections may appear on a later invoice. Estimates never generate charges. Cancellation does not automatically remove retained resources or settle late usage; outstanding service charges remain payable.
Cost estimates are illustrations, not quotes or spending caps. Actual charges depend on the resources and usage you authorize, applicable third-party pricing, taxes, and any agreed fees. You are responsible for monitoring usage and charges incurred by authorized team members.
Billing frequency, currency, payment due dates, renewal terms, and any refund or cancellation entitlements will be disclosed in your checkout or written service order before you purchase. Do not assume that removing a project or leaving a team cancels a paid subscription or stops underlying cloud charges.
Contact us promptly about a billing error. We may suspend paid services for overdue amounts after reasonable notice where practicable. Price changes will be communicated before they apply to your next billing period, subject to any existing written commitment. Statutory refund and consumer rights remain unaffected.
9. Privacy, backups, and data protection
Our privacy policy explains how we handle personal information. You are responsible for the personal data you place in your applications and for obtaining any necessary notices, permissions, and processing agreements before using the service for regulated information.
Maintain independent backups of your code, configuration, and data, and test your recovery process. Unless expressly included in a written service agreement, do not assume that Node110 provides backups, disaster recovery, or a particular retention period. No system can guarantee against data loss or unauthorized access.
10. Suspension and ending service
You may stop using the service and contact us to close your account or cancel an agreed service. Any subscription notice periods and outstanding payment obligations are governed by the terms disclosed when you purchased. Cancellation does not erase charges already incurred.
We may suspend or terminate access for a material breach, non-payment, unlawful activity, or a serious security risk. Where practicable, we will explain the issue and provide a reasonable opportunity to resolve it; urgent risks or legal requirements may require action without advance notice.
Export the data you need before service ends. Contact us about available export options; access and retention after termination are not guaranteed unless agreed in writing or required by law. Provisions about accrued payment obligations, ownership, and liability continue where relevant after termination.
11. Availability and warranties
We aim to provide a reliable service, but maintenance, failures, security incidents, and third-party outages may interrupt access. No service-level agreement, uptime percentage, response time, or service credit applies unless expressly agreed in writing.
To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not promise uninterrupted, error-free operation or that the service will meet every requirement. This does not exclude warranties or guarantees that cannot lawfully be excluded.
12. Limits of liability
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, including lost profits, lost business opportunities, or loss of goodwill arising from this agreement.
To the extent permitted by law, Node110’s total liability arising from the service is limited to the amounts you paid to Node110 for the affected service during the 12 months before the event giving rise to the claim. A separate written service agreement may provide different limits.
These limits do not apply to fraud, willful misconduct, or any liability that applicable law does not allow a party to exclude or limit. Nothing in these terms removes mandatory consumer rights.
13. Changes to these terms
We may update these terms and will change the revision date on this page. For material changes affecting existing accounts, we will provide reasonable advance notice through email or the service where practicable, unless an urgent legal or security requirement prevents it.
Changes do not apply retroactively to disputes that arose before they took effect. If you do not agree to a material change, stop using the affected service and contact us about cancellation before it takes effect. Any additional consent required by law will be obtained.
14. Questions and disputes
Please contact Node110 with questions, complaints, or disputes so we can try to resolve them. Any governing law or venue agreed in a written service order is subject to mandatory local protections. Otherwise, applicable law determines those matters; these terms do not impose mandatory arbitration or waive statutory rights to bring a claim.
If part of these terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
